ASG Nederland B.V. (hereinafter: ASG) offers digital solutions to help building owners and residents monitor, regulate and invoice their energy use. As part of the services we offer, we process personal data. This privacy statement explains what personal data we process and how we handle it.

Our privacy and cookie statement in brief

Your privacy is of great importance to us. We therefore comply with the General Data Protection Regulation (hereinafter: GDPR). This means that we:

Record our purposes before we process your personal data, as set out in this privacy and cookie statement.

Store as little personal data as possible and only the data necessary for our purposes.

Ask for explicit consent for the processing of your personal data, should consent be required.

Take the necessary security measures to protect your personal data. We also impose these obligations on parties who process personal data on our behalf.

Respect your rights, such as the right of access, rectification or erasure of your personal data processed by us.

Why do we use your personal data?

We collect various types of personal data from you. In this privacy and cookie statement, we specify for each processing what data we process, for what purpose and for how long these data are stored. If you have any questions or would like to know exactly what information we store about you, please contact us. Our contact details are mentioned at the bottom of this privacy statement.

Contact requests and communication via de website

When you send us an e-mail, fill in the contact form on the website, contact us by telephone, or contact us in any other way, you agree to our terms and conditions of contact (execution of the agreement).

For this purpose, we process the following personal data:

• Name
• Business information (if you contact us from a business perspective)
• Contact details (e-mail address and telephone number)
• Any information you provide as part of the content of a message

We store these contact moments with the personal data you provide for the purpose of carrying out the contract and handling your complaint if necessary. We keep this information for as long as necessary for this contact or up to 2 years after we last had contact with you, because we want to make sure we have handled your question or complaint properly. Financial data, f.e. invoices, will be held for 7 years for fiscal reasons.

Energy insights via the ASG Home App and Dashboards

We offer the ASG Home App, a mobile application that you can download via the App Store and Google Play. Through the app, you can keep track of your energy consumption (performance of the agreement).

To activate the ASG Home App, we process the following personal data:

• Client number
• House number (+ addition)
• Email address
• Password
• Apple ID
• Google Play account
• Contact details (email address and phone number)
• Location details

Once you have downloaded the app, ASG provides real-time insights into energy consumption and costs via the ASG Home app or online dashboards. These tools allow residents and housing associations to analyse, compare and monitor energy usage (performance of the agreement).

To provide this service, we process the following personal data:

Related to energy cost:

• Expected annual costs based on your current usage pattern
• Expected monthly costs
• Estimated costs now
• Actual costs
• Difference in percentage between actual and estimated costs
• Total costs now
• Fixed costs now
• Variable costs now

Related to energy usage:

• Total usage now (in GJ, m3 or units)
• Expected annual usage
• Expected monthly usage
• Estimated monthly usage
• Actual monthly usage
• Difference in percentage between actual and estimated usage this month
• Meter reading
• Invoices and deposits

We will store your data for as long as you have the application or for up to 2 years after you last used your account as we will then assume you no longer wish to use our services. Financial data may be stored up to 7 years due to fiscal reasons.

Energy Costs Allocation and Billing

ASG calculates heating, cooling and hot water costs and provides transparent annual or final settlements for residents and housing associations. We do this to produce accurate and transparent energy cost statements based on measured consumption data (performance of the agreement).

To do this, we process the following personal data:

• Metering data
• Apartment and building details
• Name and address
• Contact details (email address and telephone number)
• Energy consumption and cost data

We will store your data for at least the statutory administrative and fiscal retention period of 7 years.

Energy Management and Optimisation Services

ASG provides energy management services to housing associations, including data analysis, optimisation advice and sustainability recommendations. We do this to optimise energy systems, reduce energy consumption and support sustainability objectives (performance of the agreement).

To do this, we process the following personal data:

• Aggregated metering data a building level
• Technical performance and system data
• Contact details of representatives of housing associations (name, business email address and telephone number)

We will store this data for as long as necessary to provide the services. Data may be anonymised after that.

Notifications

When using our application, you can choose to have us send you notifications. For example, you can receive a notification when a new message is ready for you within the application. This notification will then appear on your device. We will only send you notifications and use this data with your consent.

For this purpose, we process the following personal data:

• Unique user ID

We store this information until you withdraw your consent. You can withdraw your consent at any time by adjusting your preferences in the application settings.

Supplier services

We purchase our products from various suppliers. In this context, we require various data to complete the order (execution of the agreement).

For this purpose, we process the following personal data:

• Company name
• Business address
• Name contact person
• Contact details (e-mail address and telephone number)
• Financial details
• Any other information you share with us

We store this data for the duration of the agreement. We keep some data longer if we are legally obligated to do so (e.g., because of the 7-year tax retention obligation).

Job applications

If you apply for one of our job openings or submit an open application, we process your personal data for the purpose of handling your application and in preparation for a possible employment contract.

For this purpose, we process the following personal data:

• Name
• Contact details (e-mail address and telephone number)
• Curriculum Vitae
• Motivation letter
• References
• Any other information you provide with your application

Your application details are stored for a maximum of 4 weeks after the position has been filled. We store this information so that we can contact you should the position become available again within the probationary period. If we are unable to offer you a position at this time, we may – with your consent – keep the application data for one more year. You can revoke your consent at any time by sending us an e-mail. We will store your application data in your personnel file should you decide to work for us. This file will be stored for as long as necessary, and the application data will be kept for a maximum of 2 years after entering into employment.

A social media and internet screening can be part of the application procedure. This is necessary for us to preserve our image when hiring new staff; we do this on a legitimate interest basis. We will do a search of your name on Google and any profile you may have on various social media. This applies, of course, insofar as these profiles are public. We will not ask you to grant us access to a private social media page or to accept a request from us. The results of the screening will be discussed with you. Should you have any objections to this, you can inform us by e-mail at the time of your application.

Visiting one of our offices

When you visit one of our offices by appointment, we record the following personal data:

• Name
• Contact details
• Address details

This data will remain in the planner for a maximum of two years.

When can we share your personal data with third parties?

ASG will only share your data with third parties when we are allowed to do so based on the current legislation. We may provide your personal data to third parties when:

We have contracted them to process certain data;

We have a legal basis to do so;

We are legally obligated to do so (e.g., if the police demand this in case of a suspicion of a crime).

ASG processes all personal data. ASG stores personal data with software from the following third parties:

• AWS
• Microsoft Teams
• Monday.com
• Moneybird.

ASG may provide your personal data to parties located outside the European Economic Area (EEA) to provide those services. We will only do so if there is an appropriate level of protection for the processing of personal data.

This privacy statement applies only to the services of ASG. We are not responsible for the privacy practices of other websites that can be accessed through a link on our website.

Social media buttons

We use a social media button for LinkedIn on our website that redirects you to our LinkedIn page. We also provide videos through YouTube on our website. Clicking the social media buttons will redirect you to the relevant social media platform, where you have the option to follow us and share content. This button operates through bits of code provided by LinkedIn and YouTube. On the social media platform, you will also see advertisements. Cookies

Our website uses first-party and third-party cookies. Cookies are small data files that can be automatically stored on or read from the visitor’s device (such as PC, tablet or smartphone) when visiting a website. This is done via the web browser on the device.

We take the security and protection of your personal data very seriously. We therefore take appropriate technical and organisational security measures regarding the processing of personal data to be carried out, against loss or against any form of unlawful processing (such as unauthorized access, corruption, alteration or disclosure of personal data). We constantly update security and pay close attention to what can go wrong.

What are your privacy rights?

You can always contact us if you have any questions regarding our privacy and cookie statement. Besides that, you have the following rights regarding your personal data:

• Right of access: you have the right to access the personal data we process about you.
• Right to rectification: you have the right to correct or supplement the personal data we process about you, e.g., if they are incorrect or incomplete.
• Right to object: you have the right to object to the processing of your personal data and to direct marketing.
• Right to erasure: you may request us to erase your personal data.
• Right to withdraw your consent: if you have consented to us processing personal data, you can withdraw your consent at any time.

If you file a request, we may ask you to identify yourself before we can fulfil your request. We do this to make sure that the requested personal data belongs to the right person.
